# Privacy Policy

This Privacy Policy ("Policy") for **Namas Labs Private Limited** ("HyprEarn", "Company", "we", "our", or "us") describes how we may process personal data we collect from users of the Company's website, **hyprearn.com**, including any of its subdomains ("Website"), in accordance with applicable law. For the purposes of applicable data protection laws, the Company is the controller. For the purposes of this Policy, "you" and "your" refers to you as a user of the Website.

Please read this Policy carefully so that you understand your rights in relation to your personal data and how we may collect, use and process it. If you do not agree to this Policy, do not use, access, connect to, or interact with the Website, or otherwise provide your information to us. **The Website and its features are not available to users located in certain restricted jurisdictions (see "Geographic Restrictions and Restricted Jurisdictions" below).**<br>

**Geographic Restrictions and Restricted Jurisdictions**

HyprEarn's mobile application is not distributed through the Apple App Store in Iran, Syria, North Korea, the United Kingdom, Cuba, Russia, Belarus or Myanmar. These jurisdictions are excluded because of sanctions exposure, protocol-level restrictions, elevated compliance risk or regulatory requirements not currently supported by HyprEarn's distribution model.

HyprEarn also applies its own country-level access restriction covering the same jurisdictions. These restrictions are applied at the network edge on the basis of the country inferred from your IP address, through our hosting and content-delivery providers, and are used only to restrict access from the restricted jurisdictions listed above. We do not collect device GPS or precise location for this purpose, and we do not use this data for any purpose other than applying these restrictions.

These restrictions are HyprEarn's own and are applied in addition to the controls that each third-party decentralised protocol independently applies to its own services. They are not a substitute for those controls, and HyprEarn does not override, bypass or circumvent them.

HyprEarn does not perform identity verification, know-your-customer checks, sanctions screening, wallet screening or transaction monitoring. Attempting to circumvent these restrictions, including through the use of a VPN or proxy, is prohibited and may result in access being blocked.

Separately and independently, each third-party decentralised protocol accessible through HyprEarn determines the jurisdictions, persons and activities for which its own services are available, and applies its own geographic, sanctions, eligibility and regulatory controls. Those restrictions apply in full when the protocol is accessed through HyprEarn. HyprEarn does not override, bypass or circumvent them, and does not provide an alternative route to a service a protocol has restricted.

Availability of HyprEarn in a country does not mean that every integrated protocol is available to every user in that country. Before accessing an integrated protocol you are responsible for confirming that you are legally permitted to use it, that you satisfy its eligibility requirements, that your use complies with applicable law, that you are not located in or ordinarily resident in a jurisdiction it prohibits, and that you are not subject to applicable sanctions.<br>

### Personal Data We Collect, Why We Process It and the Legal Basis for Processing

When you access, use, connect to, or interact with the Website, we may collect certain categories of information about you, including personal data, from a variety of sources.

#### Information you provide to us

This may include: (i) any digital-asset, smart-contract, or protocol address ("Wallet") information; and (ii) geolocation data. You provide this data when you connect your Wallet to the Website to access our trading engine, agents and rewards features.

Other data may include transaction data or history, such as your public blockchain transaction history, perpetual trading activity, agent allocations, referral activity and other information associated with a linked address or Wallet and token holdings. If you contact us, we will collect the content of our communications with you and any personal data contained within them, including the email address you use to reach us.

#### Information we collect automatically

When you visit certain pages on our Website, our servers record each access in a log file. The following data may be collected: (i) the date and time of access; (ii) the country from which the Website is accessed; (iii) any API endpoints accessed; (iv) user-agent details; (v) the operating system of your device and the browser you use (provider, version and language); and (vi) the transmission protocol used.

We may also use web beacons, geolocation and tracking technologies and similar tools when you visit the Website to collect information about your access to, use of, connection to, or interaction with the Website ("Usage Data"), which may be integrated with third-party service providers. In our legitimate interests, we may use this data to create aggregated, anonymized, or de-identified data.

#### AI-generated trade setups

Certain features of the Website provide AI-powered, on-demand trade setups, including suggested entry, exit and position-sizing recommendations and risk simulations. To generate these, we may process your Wallet activity, trading history and Usage Data. These outputs are recommendations only; you retain full control over whether to execute any trade and we do not make trades on your behalf without your action.

#### Third-party wallet connections and disclaimer

Our services require you to connect a compatible third-party digital Wallet. By using such a Wallet, you agree that your access to, use of and interactions with it are governed by the policies of the applicable Wallet provider and that you are using the Wallet in accordance with that provider's terms and conditions.

Wallets are not maintained, supported by, or affiliated with the Company. Our Agents are non-custodial, meaning we do not take custody of your assets. We expressly disclaim any liability for actions arising from your use of third-party Wallets, including, without limitation, actions relating to the use or disclosure of personal information by such Wallets.

#### Legal basis for processing

We generally process the information we collect when necessary to perform our contract with you. For example, we process it to enable your access to, use of, and interaction with the Website, including: (i) facilitating your connection to the Website; and (ii) generating AI trade setups and operating agent and rewards features you choose to use. This processing is carried out to perform our contract with you and in our legitimate interests to provide you access to the Website.

With your consent, we may use collected data, including Usage Data, to tailor features and content to you and present it effectively for your device. We may also run analytics to better understand your experience with the Website.

We may also process this data in our legitimate interests to support system security and stability, conduct troubleshooting, data analytics, testing and research, enable optimization and internal statistical analysis and to maintain the safety and security of our users and the Website. In addition, we may use your information to comply with applicable legal obligations, enforce our terms and protect or defend the Website, our rights and the rights of our users or others.

#### Cookie policy

We use cookies to enhance your experience when accessing and using the Website. The cookies we use are strictly necessary cookies, which are integral to our ability to provide the best user experience and to help us understand general usage patterns. These cookies are not used for marketing purposes. By continuing to use the Website, you consent to the placement of these cookies.

### Your Rights

Under applicable data protection laws, you may have certain rights in relation to your personal data, which may include:

* **Access** to the personal data we hold, how we use it and who we share it with;
* **Correction** of inaccurate or incomplete personal data we hold about you, which we may verify before making changes;
* **Deletion** of your personal data, in certain circumstances;
* **Objection** to the processing of your personal data, in certain circumstances;
* **Restriction** of the processing of your personal data, in certain circumstances;
* **Portability** of your personal data in a structured, commonly used, machine-readable format;
* **Withdrawal of consent**, where we rely on consent to process personal data; this will not affect processing carried out before consent is withdrawn or on legal bases other than consent.

You may submit a written request concerning the processing of your personal data to **<support@hyprearn.com>**. Prior to responding, we will require you to verify your identity. We may have valid legal reasons to refuse a request and will inform you if that is the case.

These rights apply only in certain circumstances and may be limited by law. Such limitations may apply, for example, where fulfilling your request would adversely affect other individuals, our trade secrets, or intellectual property, where overriding public interests apply, or where we are required by law to retain your data. To the extent required under applicable law, we will respond without undue delay and, where required, within the timeframes set by applicable law.

### Sharing of Personal Data

In certain circumstances, we may share your information with third parties with your consent, as necessary, or as otherwise required or permitted by law, including:

* **Service providers and vendors** who process data on our behalf. These may include blockchain analysis providers, screening providers, developers, content-delivery providers, and data analytics providers, assisting with functions such as geo-blocking based on IP address and collecting anonymized device information for analytics.
* **Connected decentralized exchanges and protocols** to the extent necessary to route and execute trades and agent strategies you initiate across multiple DEXs.
* **Professional advisors**, in our legitimate interests or as required by law.
* **Legal and security purposes**, to protect our Website, in our legitimate interests or as required by law.

Your personal information may be transferred to and stored or processed in countries outside the jurisdiction in which you live. It may also be processed by staff or third-party service providers operating outside your country of residence. We will take steps reasonably necessary to ensure your information is treated securely and in accordance with this Policy and where required by law we will put in place appropriate safeguards for any such transfer.

### Retention

We will retain your personal data only for as long as necessary to fulfill the purposes for which it was collected, including to satisfy any legal, accounting, or reporting requirements, or as otherwise required by law. The retention period depends on the nature of the data and the purpose for which it was processed.

### Children's Privacy and Data Protection

If we become aware that we have unknowingly collected information about any person under eighteen (18) years of age, we will make commercially reasonable efforts to delete such personal data from our records.

### Security Measures Taken to Protect Personal Data

Despite our efforts to protect your personal data, we cannot guarantee perfect security of information transmitted through the Website. Any information you send to us electronically may not be secure while in transit and any transmission is at your own risk.

### Usage Data Collection

When you access, use, connect to, or interact with the Website, the Company and its third-party service providers may receive and record personal data you have provided and your digital signature.

### Social Media and Other Third-Party Websites and Links

We may provide links on the Website to other websites or platforms operated by third parties, including social media or content platforms such as X (formerly Twitter), Telegram and YouTube. We do not own, operate, or control such third-party websites. If you follow links to sites not operated by us, you should review their privacy and security policies and terms. We do not guarantee and are not responsible for the privacy, security, or content of these sites.

When you open a link to a social media platform from the Website, a direct connection may be established between your browser and that platform's server, providing it with information that you visited the Website and accessed the link. If you access such a link while logged in to that platform, your visit may be linked to your account on that platform. To prevent this, log out before clicking the relevant links.

### Periodic Reviews and Updates to This Policy

Depending on your location, you may have rights under data-protection laws applicable to you, including, where relevant, Singapore's Personal Data Protection Act 2012 (PDPA), the EU General Data Protection Regulation 2016/679 and the UK General Data Protection Regulation. You may be able to file a claim with the relevant data protection supervisory authority in your jurisdiction, such as the Personal Data Protection Commission (PDPC) in Singapore. Other applicable global privacy and data-protection laws may provide you with additional rights.

We may review and update this Policy from time to time. Updates will apply only to information collected after the date of the change. If we make material changes, we will update the "Last updated" date at the top of this Policy.
